Safeguarded rights (pensions on divorce)

This term "safeguarded rights" used to relate to the portion of Protected Rights that are included in the ‘pension credit’ payment following a pension sharing order on divorce, or dissolution of a civil partnership. Safeguarded rights previously had some unusual provisions that normal Protected Rights pension rights did not.
However, the restrictions applying to safeguarded rights were removed from 6 April 2009, effectively abolishing the term and so they are now recorded as either ‘excess benefits’ or Protected Rights.
